The Emergency Measures in the Public Interest (Covid-19) Bill 2020 (“the Bill”) has now been signed into law.

Key Effects on the Residential Tenancies Act 2004 is as follows:

Ban on Evictions – Landlords may not serve a notice to terminate a residential tenancy during the period of the emergency. The emergency period shall be a period of 3 months commencing on 29th March 2020. Where a Notice of Termination was validly served prior to the period of the emergency the notice period shall include the statutory notice period plus the 3 month emergency period in its calculations

Rent Increases – Rental increases due to take effect during the period covered by the emergency period shall not now take effect. Those increases shall take effect following the period of the emergency.

Commercial Tenants – Eviction provisions of the bill also extends over Commercial tenancies. No commercial tenant may be evicted over the period
